These Terms and Conditions constitute a legally binding agreement between Invincimail ('we', 'us', 'our'), a sole trader business operating under ABN 25 192 826 642, and the individual or entity ('Customer', 'you', 'your') who has agreed to be bound by these Terms.
By checking the 'I agree to these Terms and Conditions' box and subscribing to a plan, you confirm that you have read, understood, and agree to be bound by these Terms.
Invincimail offers a Gold and Platinum plan to Customers. The Customer acknowledges that the features outlined in Invincimail's Platinum Plan are only accessible through the purchase of the Platinum Plan and cannot be obtained by purchasing Invincimail's Gold Plan.
Gold Plan provides an email inbox filter which scans incoming email messages for the Customer's chosen inbox, with a dashboard that displays live filtered inbox statistics. The Customer may select between high risk inbox email deletion, or both medium and high risk inbox email deletion, determined by the algorithmic risk score assigned by the inbox filter, accessed through the Invincimail dashboard.
Platinum Plan provides an email inbox filter which scans incoming email messages for the Customer's chosen inbox or inboxes, as well as AI-generated attachment detection, with a dashboard displaying live filtered inbox statistics. The Platinum Plan also provides AES-256-GCM end-to-end encryption for outgoing emails and an encrypted messages tracker in the dashboard. The Customer may enable or disable encryption, enable or disable encrypted replies, and select between high risk or both medium and high risk email deletion. These settings are accessed through the Invincimail dashboard.
The Customer acknowledges that the Service is designed exclusively for use with Google Workspace and Microsoft 365 Business email accounts. Use of the Service with consumer email accounts including but not limited to @gmail.com, @outlook.com, @hotmail.com, and equivalent addresses is not supported and may result in a denial of service or service failure.
Invincimail's Service is provided on a commercially reasonable effort basis. Invincimail does not warrant or represent that the Service will detect all malicious, harmful, or unwarranted emails. Email threat detection is a probabilistic process and no scanning service can guarantee the interception of all threats. The Customer acknowledges that the Service is a supplementary security layer and does not replace the Customer's own cybersecurity obligations, employee and staff training, or platform-level security controls.
All new subscriptions include a thirty (30) day free trial period commencing on the date of subscription. No charge will be applied during this free trial period. The free trial will automatically convert to a paid subscription at the applicable plan rate at the conclusion of the trial period unless the Customer cancels before the trial expires. Invincimail will send a reminder notification to the Customer's registered contact email address prior to trial conversion.
Gold Plan billing: AUD $15.00 per month, billed monthly, for one protected mailbox.
Platinum Plan billing: tiered per-mailbox monthly billing at AUD $35.00 per mailbox for mailboxes 1–5, AUD $25.00 per mailbox for mailboxes 6–15, and AUD $20.00 per mailbox for mailboxes 16–50. Platinum Plan pricing is subject to change.
Billing is processed by Stripe on behalf of Invincimail. The Customer's payment card data is handled exclusively by Stripe and never transmitted to or stored by Invincimail. Subscriptions renew automatically on a monthly basis unless cancelled. All prices are in Australian Dollars (AUD).
Customers are entitled to a full refund of subscription fees paid within thirty (30) calendar days of the first payment date. Refund requests must be submitted through the account portal, the refund form on the Invincimail website, or by contacting contact@invincimail.com.
Refunds will be processed within ten (10) business days of approval. No refund is available after the thirty (30) day refund window has expired except where required by Australian Consumer Law.
Customers may cancel their subscription at any time through the account portal, the cancellation link in the left sidebar, or by contacting contact@invincimail.com. Cancellation will take effect at the end of the Customer's current billing period. No partial refunds are provided for unused days within a billing period except within the thirty (30) day refund window described in clause 4.
Upon cancellation, the Customer's protected account configuration will be deactivated and Invincimail's Service will cease. Upon cancellation of a Platinum Plan, end-to-end encryption will be disabled for all protected mailboxes. Previously encrypted messages stored in Invincimail's secure message collection will remain accessible for the duration of the message retention period, after which they will be automatically deleted in accordance with Invincimail's Data Retention Policy.
To the maximum extent permitted by applicable law, Invincimail's total aggregate liability to the Customer for any claim arising out of or in connection with these Terms or the Service, whether in contract, tort (including negligence), statute, or otherwise, shall not exceed the total fees paid by the Customer to Invincimail in the three (3) month period immediately preceding the event giving rise to the claim.
To the maximum extent permitted by applicable law, Invincimail shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business, or loss of goodwill, arising out of or in connection with the Service, even if Invincimail has been advised of the possibility of such damages.
Nothing in these Terms limits or excludes any guarantee, warranty, right, or remedy that cannot be excluded under the Australian Consumer Law or any other applicable law.
In the event of a confirmed security incident that Invincimail reasonably believes has affected the Customer's data, Invincimail will notify the Customer within a reasonable timeframe of becoming aware of the confirmed incident. Notification will be provided to the Customer's registered contact email address and will include a description of the nature of the incident, the categories of data involved, the steps Invincimail has taken in response, and recommended actions for the Customer.
All intellectual property rights in the Invincimail platform, software, machine learning models, scanning algorithms, website, and associated documentation are and remain the exclusive property of Invincimail. The Customer's subscription grants a non-exclusive, non-transferable, revocable licence to use the Service during the subscription period only. Nothing in these Terms transfers any intellectual property rights to the Customer.
The Customer agrees not to use the Service in any manner that:
These Terms are governed by and construed in accordance with the laws of Queensland, Australia. The parties submit to the exclusive jurisdiction of the courts of Queensland, Australia for the resolution of any dispute arising out of or in connection with these Terms. Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief.
Invincimail reserves the right to modify these Terms at any time. Material changes will be notified to the Customer via the registered contact email address at least fourteen (14) calendar days before they take effect. Continued use of the Service after the effective date of the changes constitutes acceptance of the revised Terms.
These Terms and Conditions should be read in conjunction with Invincimail's Privacy Policy, which governs the collection, use, and storage of personal information in connection with the Service.
